Monetary Restriction Policy for Fraudulent/Deceptive Registration

1. Overview
Temu is committed to maintaining a secure and trustworthy marketplace. Sellers are strictly prohibited from engaging in any fraudulent, deceptive or illegal activities relative to their account registration or ongoing involvement with the Temu Platform.
This Monetary Restriction Policy for Fraudulent/Deceptive Registration (“Policy”) explains when Temu may impose monetary restrictions on funds in sellers' accounts if Temu detects any fraudulent, deceptive or other illegal acts conducted or suspectedly conducted by the seller. These are important measures to safeguard our platform and protect users from fraudulent, deceptive, or otherwise illegal activities.
As a seller on Temu, you must read this Policy carefully. This Policy will be updated periodically, and it is your responsibility to refer to this page frequently.
Unless otherwise specified, defined terms used in this Policy shall have the same meaning as in the Temu Seller EU Services Agreement.
This Policy forms part of the Temu Seller EU Services Agreement. This Policy should be read in conjunction with other Temu EU Seller Rules which collectively govern seller conduct on the Temu Platform.
2. Fraudulent, deceptive or illegal activities
We may restrict the withdrawal of funds in Your Account if you engage in fraudulent, deceptive, or illegal activities relative to the Temu Platform. Such activities include, but are not limited to, the following:
(i) Uploading fake, false, altered or unauthorized identification documents and/or information. This includes, without limitation, business information, contact information, tax information, bank information, and bank statements;
(ii) Uploading fake, altered or unauthorized logos, trademarks, copyrights, or other intellectual property;
(iii) Providing false or fake contact person information or entity details. This includes, but is not limited to, information regarding the seller’s legal representatives, directors, partners, management, members, owners, shareholders, beneficiaries, etc.;
(iv) Uploading other fake, altered or unauthorized supporting documents required by Temu. These include, but are not limited to, utility bills, authorization letters, certificates of incorporation, and third-party statements;
(v) Circumventing verification processes or manipulating Temu systems;
(vi) Conducting transactions using an account registered through any fraudulent, deceptive or illegal methods;
(vii) Colluding with any third party during the registration process, including but not limited to fraudulently registering stores under any third party’s name; and
(viii) Any other conduct which constitutes a breach of the Temu EU Seller Rules or which constitutes deceptive, fraudulent, or illegal conduct relative to the Temu account registration procedure.
For the avoidance of doubt, where the actual operator/controller of a seller account (including but not limited to beneficial owners, or persons exercising effective control) is inconsistent with the account registration information, such circumstances shall constitute fraudulent and deceptive conduct under this Policy. This applies regardless of whether the submitted documents are factually accurate.
3. Monetary Restrictions
Where we reasonably believe or determine that you have engaged in or you have suspectedly engaged in any deceptive, fraudulent, or illegal activities on Temu Platform, we may impose appropriate monetary restrictions.
Based on the severity and frequency of such deceptive, fraudulent and illegal activities, we may take appropriate monetary restriction measures against you, which may include without limitation to the following:
(i) deducting part or all of the funds from Your Account, or
(ii) restricting access to all or part of the funds in Your Account on a permanent or temporary basis. This includes restricting the withdrawal of part or all of the funds from Your Account.
For the avoidance of doubt, the amount of the funds deducted by us from Your Account corresponds to the amount of the liquidated damages amount, which is a reasonable and genuine pre-estimate of our losses (“Liquidated Damages Amount”). Notwithstanding the abovementioned, in no event the amount restricted and/or deducted by us from Your Account shall be more than the balance of Your Account or the total historical sales revenue of your stores in Your Account, whichever is higher.
For the avoidance of doubt, without prejudice to our right to impose the monetary restrictions provided herein, we may impose other corrective actions as set out in the Temu EU Seller Rules.
4. Process
Where Temu determines that a seller has engaged in or reasonably believe that a seller has engaged in fraudulent, deceptive, or illegal activities, without prejudice to our right under the Temu EU Seller Rules, we will impose appropriate monetary restrictions without undue delay. Where required by Applicable Law, Temu will issue a Statement of Reasons (“SOR”) to the seller, outlining the nature of the violation and the basis for the restriction.
The SOR will include without limitation to:
· The restriction
· The fact and reason for the restriction
· Rights of appeal and redress
This process is designed to ensure transparency and compliance with Temu’s obligations under applicable laws, including the Digital Services Act (“DSA”) where relevant.
In certain circumstances, including where we are cooperating with law enforcement or regulatory authorities, or where disclosure would be unlawful or likely to prejudice an ongoing investigation, we may withhold or delay the provision of a SOR. In such cases, we will issue the SOR as soon as it is legally permissible to do so.
5. Appeal
You may appeal against the decision we made that you have conducted any fraudulent, defective and illegal activity, and the monetary restrictions taken by us within six (6) months upon receiving the SOR by following the instructions in the SOR we send you.
For the avoidance of doubt, even if you acknowledge the fact that you have conducted fraudulent, defective or illegal activity, or if your appeal against the SOR decision is rejected, or if you choose not to appeal the SOR decision, you shall still be entitled to appeal separately to lift the funds withdrawal restriction taken by us on the 61st day upon receiving the SOR (“Appeal with Acknowledgement”).
After your Appeal with Acknowledgement is submitted, we will calculate and deduct the Liquidated Damages Amount, and then release any remaining funds, and Your Account (including the affiliated account) as well as the store operated by Your Account (including the affiliated account) will be closed permanently.
As part of the appeal process, we may request that you provide additional information or documentation regarding your identity, business activities, supply chain and / or financial documents. We may validate any information that you provide with third party services or government agencies.
